What the confidentiality notice does — and doesn't do
The notice at the foot of the sheet tells an unintended recipient that the pages contain protected health information, that reviewing or sharing them is prohibited, and to notify the sender and destroy the copies. It is the standard wording used across medical, dental, and insurance offices for the mishap that actually happens: a fax dialed to the wrong number.
HIPAA does not prescribe cover sheet wording — it requires reasonable safeguards for PHI (45 CFR 164.530(c)) and the minimum necessary standard for most disclosures. A prominent notice, verified fax numbers, and a page count so recipients notice missing pages are all part of that practice. No. A cover sheet is one safeguard practice, not a compliance guarantee. If you transmit PHI through an online service, that service must support your HIPAA obligations — typically with a signed business associate agreement. PerPageFax is not HIPAA-compliant and asks users not to send PHI through it (see our privacy policy); use it for the cover sheet itself and for non-PHI documents.
Act immediately: contact the recipient by phone, ask them to destroy or return all pages, document what happened, and assess the incident under the Breach Notification Rule (45 CFR 164.400–414), which presumes a misdirected disclosure is a breach unless a documented risk assessment shows a low probability of compromise.
