Terms of Service

1. Agreement

By using PerPageFax ("the Service"), you agree to these Terms of Service.

If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old. By using the Service, you confirm you are 18 or older and can enter into a binding agreement.

3. How the Service Works

PerPageFax is an online, send-only fax service:

• Upload a document, enter a fax number, optionally add a cover page
• Each page costs $0.50
• We deliver your fax and show live tracking on a status page

4. Supported Files & Limits

Accepted formats: PDF, PNG, JPG, JPEG, HEIC, TIFF.

Non-PDF image files are automatically converted to PDF before sending.

• Max file size: 20 MB per file, 20 MB total per fax
• Max pages: 100 per fax
• Destinations: US and Canada guaranteed; international on a best-effort basis

5. Pricing & Payment

You pay $0.50 USD per page. Payment is processed by Stripe before delivery.

• Example: 3-page fax = $1.50 (3 pages at $0.50 each).
• No subscription, no minimum, no monthly or setup fees.

6. Document Handling & Retention

Your documents belong to you. We don't claim ownership or review content (beyond automated file validation).

• Files are temporarily stored during checkout and delivery
• Automatically and permanently deleted no later than 24 hours from upload, regardless of delivery status
• Transaction metadata is kept for business records and dispute resolution

7. Acceptable Use

You agree not to use the Service to:

• Send unsolicited advertisements or junk faxes (violation of the TCPA and Junk Fax Prevention Act)
• Transmit unlawful, harassing, defamatory, fraudulent, obscene, or threatening content
• Send faxes without the recipient's consent where required by law
• Infringe intellectual property, privacy, or publicity rights
• Bypass rate limits or disrupt the Service

We may refuse service, block transactions, and report violations to law enforcement.

8. Intellectual Property

Your content. You keep all rights to documents you send. We claim no ownership.

Our Service. The PerPageFax name, logo, domain, design, code, and branding are our property, protected by copyright and trademark law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

Delivery depends on factors outside our control: the recipient's fax machine, phone line quality, and carrier networks. We don't guarantee delivery to disconnected, busy, or unreachable numbers after reasonable retry attempts.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERPAGEFAX IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC FAX AT ISSUE.

11. Indemnification

You agree to indemnify PerPageFax and its officers, agents, and affiliates against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of third-party rights, or the content of faxes you send.

12. Termination

We may suspend or terminate your access at any time, without notice, for conduct we believe violates these Terms, applicable law, or is harmful to us, other users, or third parties.

13. Changes to Terms

We may update these Terms at any time. Changes take effect when posted. Continued use of the Service means you accept the updated Terms. If you disagree, stop using the Service.

14. Governing Law & Disputes

These Terms are governed by United States law.

Step 1 — Talk to us first. Before any formal action, email [email protected]. We'll try to resolve the issue informally for at least 30 days.

Step 2 — Arbitration. Unresolved disputes go to binding arbitration through the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

• Arbitration is individual only — you waive the right to class actions or class-wide arbitration
• You can opt out of arbitration within 30 days of first using the Service by emailing us with your name and a statement that you decline arbitration

15. General

• Entire agreement. These Terms plus our Privacy Policy are the full agreement.
• Severability. If any provision is unenforceable, the rest remain in effect.
• No waiver. Not enforcing a right doesn't mean we waive it.
• Force majeure. We're not liable for delays or failures from natural disasters, internet outages, carrier disruptions, or government actions.
